These terms of service ("Terms", "Agreement") are an agreement between iSpeak AI, LLC ("iSpeak AI", "us", "we", or "our") and you ("User", "you", or "your"). This Agreement sets forth the general terms and conditions of your use of the ispeak.ai website and any of its products or services, including the Marabot application hosted at marabot.ai (collectively, "Website" or "Services").
When you create an account on our Website, you are responsible for keeping your account secure and are fully accountable for all activities that occur under your account, as well as any actions taken using it. Providing inaccurate or false contact information may lead to the termination of your account. You must promptly notify us of any unauthorized use of your account or any security breaches. We are not responsible for any actions or omissions by you, including any damages resulting from such actions or omissions.
We reserve the right to suspend, disable, or delete your account, or any part of it, if we determine that you have violated any terms of this Agreement or engaged in conduct that could harm our reputation and goodwill. If your account is deleted for these reasons, you will not be allowed to re-register for our Services. Additionally, we may block your email and IP address to prevent future registrations.
Marabot.ai offers an MLS-integrated version and a non-MLS version of the platform. The MLS-integrated version is only available in select markets where we have established agreements with Multiple Listing Services (MLS). Our coverage is continuously expanding, but we do not guarantee MLS availability in all areas.
Access to the MLS-integrated version is subject to:
Users in markets where MLS integration is unavailable, or who are not approved for MLS access, will have access to the non-MLS version of Marabot. This version includes the same core functionality but does not:
MLS availability is subject to change based on agreements with MLS providers and other third parties. We reserve the right to modify, expand, or discontinue MLS integration in any market at our sole discretion. Any changes to MLS access, whether due to external factors or internal decisions, will not result in a refund, prorated credit, or modification of subscription fees. This policy applies regardless of whether a user&lsqo;s access to MLS features is added, removed, or altered.
By using Marabot, you acknowledge that MLS access is not guaranteed and depends on external factors beyond our control. All other Terms of Service remain unchanged regardless of any modifications to MLS integration.
We do not own any data, information, or material ("Content") that you submit to the Website while using our Services. As a common carrier, we are not responsible for your Content; you bear full responsibility for ensuring that your Content complies with all applicable laws, including the Fair Housing Act. This responsibility extends to any AI-generated content produced using our Services. We strongly encourage you to review and approve all AI-generated content before use. If you choose to enable auto-approvals for generated content, you remain fully responsible for the content and assume all associated risks and liabilities.
You are solely responsible for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use all submitted or generated Content. While we may, at our discretion, monitor Content on the Website submitted or created using our Services, we are not obligated to do so. Unless you explicitly grant us permission, your use of the Website does not grant us the license to use, reproduce, adapt, modify, publish, or distribute your Content for commercial, marketing, or similar purposes. However, you do grant us permission to access, copy, distribute, store, transmit, reformat, display, and perform your Content as necessary to provide the Services to you. Additionally, you understand and grant us the right to use all content, whether generated by AI or user-submitted, to train our AI models in order to improve the quality of posts.
Without limiting any of the above representations or warranties, we reserve the right, but are not obligated, to refuse or remove any Content that we reasonably believe violates our policies or is harmful or objectionable in any way.
We operate on a prepayment basis, billing monthly for our Services. Usage limits are set according to your chosen subscription tier, and exceeding these limits may require an upgrade to a higher tier. If a payment is rejected, your account may be suspended until payment is successfully processed. We may offer discounts for yearly prepayment, providing savings for users who choose to pay annually.
You can cancel your subscription at any time. Upon cancellation, your subscription will remain active until the end of the prepaid period, after which it will be terminated.
Refunds are provided at our sole discretion and are not guaranteed. Each refund request will be evaluated on a case-by-case basis.
Our Website may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, availability, promotions, or offers. We reserve the right to correct these errors, update information, or cancel orders at any time without notice, including after an order has been submitted. We are not obligated to update or clarify information on the Website, including pricing, unless required by law. Any update or refresh date on the Website does not imply that all information has been modified or is current.
Our Service allows users to connect to third-party social media platforms such as Facebook, X (formerly Twitter), Instagram, and others. When using these integrations, you are solely responsible for complying with the terms, conditions, and rules of each third-party platform. If your social media account is suspended or restricted for any reason, that is your responsibility, and we are not liable for any consequences resulting from such actions. This Agreement does not transfer any intellectual property rights from iSpeak AI, LLC or third parties to you. All rights, titles, and interests in such property remain solely with iSpeak AI, LLC. This includes all trademarks, service marks, graphics, and logos used in connection with our Website or Services, which are trademarks or registered trademarks of iSpeak AI, LLC or its licensors. Any other trademarks, service marks, graphics, and logos used in connection with our Website or Services may be the property of third parties. Your use of our Website and Services does not grant you any rights or licenses to reproduce or use any iSpeak AI, LLC or third-party trademarks.
Your use of our Website, Marabot application, or any of our Services is entirely at your own risk. All Services are provided on an "as is" and "as available" basis. iSpeak AI, LLC expressly disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Services will meet your expectations, nor that they will be uninterrupted, timely, secure, or error-free. We also do not guarantee the accuracy or reliability of any information obtained through the Services or that any defects will be corrected. Any material or data you download or otherwise obtain through our Services is done at your own risk, and you are solely responsible for any damage to your computer system or loss of data that results from such activities.
To the fullest extent permitted by law, iSpeak AI, LLC, its affiliates, officers, directors, employees, agents, suppliers, or licensors will not be liable for any indirect, incidental, special, punitive, consequential, or cover damages. This includes, but is not limited to, damages for lost profits, revenue, sales, goodwill, use or content, business impact, interruption, loss of anticipated savings, or business opportunities. This applies regardless of the cause of damages and under any theory of liability, including contract, tort, warranty, breach of statutory duty, negligence, or otherwise, even if iSpeak AI, LLC was advised of the possibility of such damages or could have foreseen them.
To the maximum extent permitted by law, the total liability of iSpeak AI, LLC and its affiliates, officers, employees, agents, suppliers, and licensors, related to the Services, will be limited to the amount you paid to iSpeak AI, LLC for the Services in the one-month period immediately preceding the first event that gave rise to the liability. These limitations and exclusions apply even if the provided remedy does not fully compensate you for any losses or fails to meet its essential purpose.
You agree to indemnify and hold iSpeak AI, LLC, along with its affiliates, directors, officers, employees, and agents, harmless from any liabilities, losses, damages, or costs, including reasonable attorneys' fees, that arise from or relate to any third-party claims, allegations, actions, disputes, or demands made against them as a result of your Content, your use of the Website or Services, or any willful misconduct on your part.
All rights and restrictions in this Agreement are intended to be applied only to the extent that they comply with applicable laws and do not render this Agreement illegal, invalid, or unenforceable. If any provision of this Agreement is found to be illegal, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue to be in full force and effect. It is the intent of the parties that the remaining provisions constitute their agreement regarding the subject matter of this Agreement.
The formation, interpretation, and performance of this Agreement, as well as any disputes arising from it, shall be governed by the substantive and procedural laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles. The exclusive jurisdiction and venue for any legal actions related to this Agreement shall be the state and federal courts located in Pennsylvania, and you hereby submit to the personal jurisdiction of these courts.
You also waive any right to a jury trial in any legal proceedings arising out of or related to this Agreement.
You may not assign, resell, sublicense, transfer, or delegate any of your rights or obligations under this Agreement, in whole or in part, without our prior written consent. This consent is at our sole discretion and is not guaranteed. Any attempt to assign or transfer your rights or obligations without our consent will be considered null and void. We reserve the right to assign any of our rights or obligations under this Agreement, in whole or in part, to a third party, including as part of a sale of assets or stock, or as part of a merger.
We reserve the right to modify this Agreement or our policies related to the Website or Services at any time. Any changes will become effective upon posting the updated Agreement on the Website. When changes are made, the updated date at the bottom of this page will be revised. By continuing to use the Website after any changes, you are consenting to the updated terms.
By using the Website or its Services, you acknowledge that you have read this Agreement and agree to all its terms and conditions. If you do not agree to abide by this Agreement, you are not authorized to use or access the Website or its Services.
